Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Romex Pest Control ("Company," "we," "us," or "our") governing your access to and use of our website, mobile applications, and pest control services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

Pest Control Services

Service Agreement

When you request pest control services, you enter into a service agreement with us. The specific terms of that agreement, including the scope of services, pricing, and payment terms, will be provided to you before services commence.

Property Access

By scheduling pest control services, you authorize our technicians to access your property at the agreed-upon time. You agree to:

• Provide safe access to areas requiring treatment
• Inform us of any pets, children, or individuals with health sensitivities
• Remove or cover items as instructed prior to treatment
• Follow all post-treatment instructions provided by our technicians

Treatment Limitations

While we strive to provide effective pest control, results may vary based on factors including pest species, infestation severity, environmental conditions, and property characteristics. We cannot guarantee complete pest elimination in all circumstances.

Payment Terms

• Pricing: Service prices are quoted before work begins and are subject to change based on the scope of work required.
• Payment Due: Payment is due upon completion of services unless otherwise agreed in writing.
• Late Payments: Late payments may incur interest at the maximum rate permitted by law.
• Collections: If your account becomes delinquent, we may engage collection agencies and you may be responsible for collection costs and attorney fees.
• Disputes: Payment disputes must be raised within 30 days of the invoice date.

Cancellation and Rescheduling

• Cancellation Notice: Please provide at least 24 hours' notice to cancel or reschedule appointments.
• Late Cancellations: Cancellations with less than 24 hours' notice may incur a cancellation fee.
• No-Shows: If you are not present for a scheduled appointment without prior notice, a trip charge may apply.
• Service Plan Cancellations: Recurring service plans may be cancelled with written notice. Prepaid amounts for future services will be refunded minus any applicable early termination fees specified in your service agreement.

Warranties and Guarantees

Specific warranty terms for our services are provided in your service agreement. General warranty conditions include:

• Warranties apply only to treated areas and specified pests
• Warranties may be voided if conditions conducive to pest activity are not corrected
• Warranty service requests must be made during the warranty period
• Warranties are non-transferable unless otherwise specified

Acceptable Use

You agree not to:

• Use the website for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the website or servers
• Transmit viruses or malicious code
• Collect user information without consent
• Use automated systems to access the website without permission

Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of Romex Pest Control or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROMEX PEST CONTROL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF OUR SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICES GIVING RISE TO THE CLAIM.

Indemnification

You agree to indemnify, defend, and hold harmless Romex Pest Control and its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorney fees) arising from your use of our Services, your violation of these Terms, or your violation of any rights of another.

Dispute Resolution

Any disputes arising from these Terms or our Services shall be resolved as follows:

• Informal Resolution: We encourage you to contact us first to resolve any disputes informally.
• Governing Law: These Terms shall be governed by the laws of the State of Texas.
• Venue: Any legal action arising from these Terms shall be brought in the state or federal courts located in Dallas County, Texas.

Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our Services after any changes constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
